CCR Disappointed That Clients May Wait Another Year In Detention Without Meaningful Way To Challenge Imprisonment

New York and Washington, DC - The Supreme Court announced today that it would not be hearing the cases of the Guantánamo detainees for the time being. The Court denied the Center for Constitutional Rights (CCR) and co-counsel's motion to hear the case with three justices dissenting and two issuing a statement that the detainees should exhaust the process set up by the Detainee Treatment Act (DTA), allowing for limited appeals from the decisions of military review panels, before they would consider ruling on constitutional questions. Attorneys with the Center for Constitutional Rights expressed disappointment with the ruling.

The Bush administration has repeatedly described the 450-500 men detained at Guantanamo as "the worst of the worst." In the words of Vice President Dick Cheney (June 23, 2005), "The people that are there are people we picked up on the battlefield, primarily in Afghanistan. They’re terrorists. They’re bomb makers. They’re facilitators of terror. They’re members of Al Qaeda and the Taliban….We’ve let go those that we’ve deemed not to be a continuing threat. But the 520-some that are there now are serious, deadly threats to the United States." The news that three inmates at Guantánamo Bay hanged themselves should not have surprised anyone who has paid the slightest attention to the twisted history of the camp that President Bush built for selected prisoners from Afghanistan and antiterrorist operations. It was the inevitable result of creating a netherworld of despair beyond the laws of civilized nations, where men were to be held without any hope of decent treatment, impartial justice or, in so many cases, even eventual release.

Witness Against Torture: A Campaign to Shut Down Guantánamo responded today to President George Bush's statements on German television last week about the U.S. prison. According to a transcript of the program released on Sunday, President Bush acknowledged the prison was a "sensitive issue," and said, "I would like to close the camp and put the prisoners on trial." He went on to say that, "Our top court must still rule on whether they should go before a civil or military court… They will get their day in court. One can't say that of the people that they killed.
